4. USER ACCOUNTS

You may register as an Agent, Agency, or Buyer. You must provide accurate, current, and complete information during registration and keep your account information updated.
4.2 Account Security
You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activities that occur under your account
- Notifying us immediately of any unauthorized use
4.3 Account Termination
We reserve the right to suspend or terminate your account if you violate these Terms or engage in fraudulent or illegal activities.
5. PLATFORM SERVICES
5.1 Marketplace Services
Realmarket.ng operates as a marketplace connecting property buyers/renters with agents and agencies. We:
- Provide a platform for listing and searching properties
- Facilitate communication between users
- Offer tools for managing property inquiries
5.2 No Direct Sales
We do not sell, rent, or lease properties directly. All transactions are between users. We are not party to any agreements made between users.
6. PROPERTY LISTINGS
6.1 Creating Listings
Agents and Agencies may create property listings. By posting a listing, you represent and warrant that:
- You have the legal right to list the property
- All information provided is accurate, current, and complete
- The listing does not violate any laws or third-party rights
- You have obtained all necessary permissions and authorizations
6.2 Listing Content Requirements
Listings must:
- Contain accurate property details (location, price, size, features)
- Include clear, authentic photographs
- Not contain misleading or false information
- Comply with Nigerian advertising and real estate laws
- Not discriminate based on race, religion, ethnicity, gender, or other protected characteristics
6.3 Prohibited Listings
You may not list properties that:
- You do not have authority to advertise
- Involve illegal activities or purposes
- Infringe on third-party intellectual property rights
- Contain offensive, defamatory, or inappropriate content
6.4 Listing Removal
We reserve the right to remove any listing that violates these Terms without prior notice.
7. USER CONDUCT

9. TRANSACTIONS BETWEEN USERS
9.1 Independent Transactions
All property transactions are solely between buyers/renters and agents/agencies. Realmarket.ng is not a party to these transactions.
9.2 Due Diligence
Users are responsible for:
- Conducting their own due diligence on properties
- Verifying all property information independently
- Inspecting properties before making commitments
- Verifying the identity and credentials of other users
- Ensuring compliance with all legal requirements for property transactions
9.3 No Guarantees
We do not guarantee:
- The accuracy of listing information
- The availability of listed properties
- The legitimacy of users or listings
- The outcome of any transaction
10. FEES AND PAYMENTS
10.1 Platform Fees
Realmarket.ng may charge fees for certain services. Current fees and payment terms will be clearly communicated to users before any charges are incurred.
10.2 Third-Party Payment Processors
Payments may be processed through third-party payment processors. Your use of such services is subject to their terms and conditions.
10.3 No Refunds
Unless required by law, fees paid to Realmarket.ng are non-refundable.
11. DISCLAIMERS AND LIMITATIONS OF LIABILITY
11.1 Platform “AS IS”
THE PLATFORM IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
11.2 No Verification
While we strive to maintain quality listings, we do not verify the accuracy of user-provided information or the legitimacy of properties listed on the Platform.
11.3 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY NIGERIAN LAW, REALMARKET.NG SHALL NOT BE LIABLE FOR:
- Any indirect, incidental, special, or consequential damages
- Loss of profits, data, or business opportunities
- Damages arising from transactions between users
- Errors or inaccuracies in listing information
- Unauthorized access to your account
- Any damages exceeding the fees paid to us in the twelve months preceding the claim
11.4 User Disputes
You agree that disputes arising between users are solely between those users. Realmarket.ng has no obligation to intervene in such disputes but may do so at its sole discretion.
12. INDEMNIFICATION
You agree to indemnify, defend, and hold harmless Realmarket.ng, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:
- Your use of the Platform
- Your violation of these Terms
- Your violation of any law or third-party rights
- Content you post on the Platform
- Transactions or disputes with other users
13. PRIVACY AND DATA PROTECTION
Your use of the Platform is also governed by our Privacy Policy. By using the Platform, you consent to our collection, use, and disclosure of your personal information as described in the Privacy Policy.
We comply with the Nigeria Data Protection Regulation (NDPR) and take reasonable measures to protect your personal data.
14. MODIFICATIONS TO TERMS

- Your listings will be removed

17. DISPUTE RESOLUTION

These Terms shall be governed by and construed in accordance with the laws of the Federal Republic of Nigeria.
17.2 Dispute Resolution Process
In the event of any dispute:
- Users should first attempt to resolve disputes directly
- If unresolved, contact Realmarket.ng for mediation
- If still unresolved, disputes shall be submitted to arbitration in accordance with the Arbitration and Conciliation Act of Nigeria
17.3 Jurisdiction
Subject to the arbitration clause above, the courts of Nigeria shall have exclusive jurisdiction over any disputes arising from these Terms.
18. GENERAL PROVISIONS
18.1 Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Realmarket.ng regarding the Platform.
18.2 Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
18.3 Waiver
Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision or any other provision.
18.4 Assignment

We shall not be liable for any delay or failure to perform resulting from causes beyond our reasonable control, including but not limited to natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, network infrastructure failures, strikes, or shortages of transportation, facilities, fuel, energy, labor, or materials.

The Platform may contain links to third-party websites or services. We are not responsible for the content, accuracy, or practices of such third parties.
18.7 Language
These Terms are drafted in English. In case of any translation, the English version shall prevail.
19. SPECIAL PROVISIONS FOR AGENTS AND AGENCIES
19.1 Professional Obligations
Agents and Agencies represent and warrant that they:
- Hold all necessary licenses and permits required by Nigerian law
- Comply with all applicable real estate regulations
- Act in good faith and with professional competence
- Maintain appropriate professional indemnity insurance (where required by law)
19.2 Verification
Agents and Agencies may be required to provide proof of credentials, licenses, or business registration upon request.
19.3 Commission Disputes
Realmarket.ng is not involved in commission arrangements between agents/agencies and property owners or buyers. Such arrangements are solely between the relevant parties.
20. REPORTING VIOLATIONS
If you become aware of any violations of these Terms or fraudulent activity, please report it immediately to:
